5.0 AI Processing Under GDPR

Where AI Features process personal data, such processing is conducted strictly under the customer’s documented instructions and for the purpose of providing the Service.

RewardinMe does not perform automated decision-making or profiling that produces legal or similarly significant effects on individuals, as defined under Article 22 of the GDPR.

Customers remain responsible for informing end-users of any AI-assisted processing within their campaigns.

5.1 GDPR Roles

• Customer: Data Controller
• RewardinMe: Data Processor

5.2 Lawful Basis

Customers are responsible for establishing lawful grounds for processing (consent, legitimate interest, contractual necessity, etc.).

5.3 Data Subject Rights

RewardinMe will reasonably assist customers in responding to:

• Access requests
• Rectification or erasure requests
• Data portability requests

Requests must be submitted in writing and verified.

5.4 Subprocessors

RewardinMe may use vetted subprocessors (cloud hosting, analytics). By using the Platform, you consent to such use.

5.5 International Transfers

Data may be processed outside the EU with appropriate safeguards in place.

5.6 AI Risk Allocation

You acknowledge that AI technologies involve inherent limitations and uncertainties. By using the AI Features, you agree that:

• AI-generated suggestions are not guarantees of success or compliance
• RewardinMe does not assume responsibility for business, reputational, regulatory, or financial outcomes
• Any regulatory exposure resulting from campaign execution remains solely with the customer

You agree to indemnify and hold harmless RewardinMe from claims arising out of:

• Use of AI-generated recommendations
• Failure to disclose AI usage to end-users where required
• Violation of laws, advertising standards, or platform policies
